Article: LOS ANGELES (Reuters) - A Chicago man who bought Microsoft Corp.'s new Xbox 360 has sued the world's largest software maker, saying the new video game console has a design flaw that causes it to overheat and freeze up.

The proposed class action claims that in Microsoft's bid to gain share in the $25 billion global video game market, the company was so intent on releasing the Xbox 360 before competing next-generation machines from Sony Corp (NYSE:SNE - news). and Nintendo Co Ltd. that it sold a "defectively designed" product.

Robert Byers, who brought the suit, said the power supply and central processing unit in the Xbox 360 overheat, affecting heat-sensitive chips and causing the console to lock up.

Microsoft spokeswoman Molly O'Donnell on Monday said the company does not comment on pending litigation.

Complaints about the problem surfaced quickly on gaming enthusiast Web sites after the Xbox 360 debuted on November 22.

Console owners reported that some systems had crashed during regular use as well as during online game play using the Xbox Live service. Problems included screens going black and the appearance of a variety of error messages.

At the time O'Donnell told Reuters: "We have received a few isolated reports of consoles not working as expected."

She declined to say how many reports Microsoft had received and said that calls reporting the issue to the company represented a "very, very small fraction" of units sold.

The lawsuit, filed on Friday in federal court in Illinois, seeks unspecified damages and litigation-related expenses, as well as the replacement or recall of Xbox 360 game consoles.

3% of the systems are defective....that's about the same amount as every other system in the history of video games.

I don't see why he's filing a lawsuit, if your system is defective, just call Microsoft and you'll have your 360 fixed within a week for free.

lol, you a Play Station boy? ;)

The first night I got my 360 it LOCKED UP....but there's a reason why, I had it in kinda of a closed area so it didn't have much "breathing room". I would get disc read errors and couldn't start games. I read the manual and it indeed says to have it in a cool ventilated area...so I did that and problems decreased for me. Now, I rarely have problems... when I have my 360 on for a long time and then I go to put in another game....it won't read it because the system is pretty hot, I just let cool off a little and it works fine. But boy, I was ****ing ****ed at first when I had those problems....I knew I couldn't get another one right away if I returned it...no stores would have it...mine was preordered.

If a woman can win millions of dollars from McDonald's for burning her hand on the coffee machine....I think it's safe to say this guy has a shot at winning something.

He probably will get something....Didn't Sony lose a lawsuit over their faulty DVD drives on the PS2?

Just goes to show how flawed our justice system is.

Well there was that one lady who was talking on a cell phone and driving a stick shift with a McDonald's coffe in her hand and when she go into an accident she won a lawsuit for McDonald's coffee being too hot.

I need to come up with a get rich quick scheme like that!

Just goes to show how flawed our justice system is.
I am not too sure about that PS2 lawsuit, but I do remember that Sony was sued over their DualShock controllers.

What a joke. They need to chain this guy up and shock the hell out of him using a cattle prod for at least 3 weeks. Seriously,the judge needs to ram the XBox where the sun doesn't shine on this tool. Just because your freaking toy doesn't work you cry like a 8 year old girl and want damages?

That is ridiculous they hype up this thing so much its gonna be amazing..it will do this and that...but they cant find a way to stop it from screwing up?

Make sure I dont lose my house in a fire or lock up beacause there isnt enough "breathing room" then make lifelike graphics techonology....damn.

Thats why Im not wasting my money until the price drops.

Give me a break...If you dont like it DONT BUY ONE....what about alll the other products that have defects?????? Yeah they are trying to rip off the americans when they will fix it for free....good thinking. :hiya:
