If u purchase xbox live can u download updated rosters through Xbox live or is that a whole different program?????

Yes, you can download updated rosters with XBOX live. You do not need another program.

can you use these rosters in your franchise, etc? are the rosters fairly up to date?

When you update the rosters online, it changes the original rosters in the game. Im not quite sure what would happen if you had ricky williams on your franchise and then updated, I would think he would stay on there until you made a new franchise with the new dolphins roster. The most recent update for me is August 4th (ricky williams gone, eddie george to cowboys etc.) Tim Brown is a free agent right now but he hasnt been assigned to the bucs yet. I hope they update again soon cause I want him on the bucs :P
